Dubai Off-Plan Booking Form: 12 Checks Before Paying a Reservation Deposit

A Dubai off-plan booking form can be only a few pages long, but signing it and transferring a reservation amount may create immediate contractual and practical consequences. It is not the same document as the full sale and purchase agreement, and neither document is the same as a provisional-registration certificate. Before paying, a buyer should connect the advertisement to a verified permit, the project to its official identity, the unit to an exact price and payment schedule, and the beneficiary to the approved collection route for that particular amount. This Development Resolution guide provides a twelve-field pre-SPA check and explains how to preserve the transaction from the first advertisement through booking, SPA signature and Oqood registration. It is general information and does not decide the legal character of a particular amount or whether it must be refunded or retained.

1. Treat the booking form as an operative record, not disposable paperwork

Preserve the advertisement, availability sheet, booking form, payment request and receipt exactly as received. Record the date, sender, project name, developer, broker, unit, price, amount requested, proposed payment method and deadline for signing the SPA. Do not rely on a later summary of what the salesperson said.

Dubai Land Department service material expressly recognises a signed reservation or booking form in some later procedures. Its settlement service accepts a booking form or sale contract as supporting evidence, and its provisional-deregistration service may use the address stated in a booking form where the SPA is unavailable. That does not mean every booking form has identical legal effect; it shows why the document should be read and preserved rather than treated as a harmless expression of interest.

Label oral statements separately. If a promised view, unit allocation, financing condition, discount, handover estimate or refund assurance matters to the decision, ask for the exact term to appear in the signed record or an authorised written clarification.

2. Separate the advertisement, booking, SPA and registration stages

Four records are often compressed into the word “purchase.” The advertisement presents the offering; its permit and authorised details require verification. A booking form may reserve a specified unit and record an initial payment. The SPA contains the fuller contractual terms. Provisional registration records the applicable off-plan sale with DLD and produces its own electronic certificate.

One stage does not automatically prove completion of the next. A permitted advertisement does not establish that the buyer agreed to every SPA term. A receipt does not itself establish provisional registration. A signed booking form should not be described as an Oqood certificate, while an application or transaction reference should not be described as the final registration output.

Use a dated transaction line: advertisement and permit checked; booking signed; amount transferred; SPA received; SPA signed; registration submitted; provisional-registration e-certificate received. Keep a blank date where an event has not occurred.

3. Verify that the exact project can be marketed and launched

Start with the official project identity, not only the brand name. Record the DLD project number, registered name, developer, land or phase reference, current status and retrieval date. Similar names, towers or phases can otherwise be confused.

DLD’s published FAQ says a new project may be launched or announced after the registration procedures are completed and an accreditation certificate is obtained. The implementing bylaw also states that an off-plan disposition made before approval to commence the project and registration with DLD is void within the scope of that provision.

These are project-level checks. They do not certify the suitability of the unit, the buyer’s finance, the promised return or the eventual handover date. If the project or phase cannot be matched, keep the booking decision open and request the official identifiers.

4. Verify the advertisement and the person presenting it

Scan the Madmoun QR code on the advertisement and preserve the result with the advertisement itself. DLD says the QR code allows customers to check the advertisement’s authenticity, validity and authorised details, including information about the advertising company and property.

Confirm the broker and brokerage through DLD or Dubai REST. DLD’s FAQ says a broker must be licensed, registered in the brokers register and hold a brokerage card. If the person signing or accepting instructions acts for the developer, ask for the entity name and authority behind that role.

A valid advertising permit is not a guarantee that every spoken claim is incorporated into the transaction. Compare the official advertisement details with the booking form, particularly the developer, project, unit type, price basis and campaign validity.

5. Verify the beneficiary and approved collection route before transferring money

Dubai’s escrow law provides for an account opened in the name of the real-estate development project into which the off-plan purchaser and project-finance payments governed by that framework are deposited. Separate projects require separate accounts. Record the project name, beneficiary, bank, account reference, description of the amount and source of the instructions supplied to you.

Where a developer engages a broker to market a project, Article 12 of the implementing bylaw requires the broker to deposit the relevant unit sale price into the project escrow account, prohibits depositing that price into the broker’s own account and prohibits deducting commission from it before deposit. This applies where the amount constitutes all or part of the unit sale price; an amount should not be brought within Article 12 merely because it is labelled a booking or reservation deposit.

For a preliminary reservation, expression-of-interest fee or separately described charge, verify its legal character, approved collection route and written treatment with DLD or qualified UAE counsel before paying. DLD’s exhibition-permit terms illustrate why the distinction matters: sales are prohibited during the exhibition, while preliminary reservations are permitted. Independently verify all transfer instructions through an authenticated channel, preserve the bank confirmation and obtain a receipt identifying the purchaser, unit, amount and stated purpose.

6. Extract these twelve fields before signing or paying

The following is a Development Resolution working checklist, not a claim that every booking form uses the same format. Copy each answer from the document or mark it unresolved. Do not complete a missing term from memory or a brochure.

The objective is to expose mismatches before the short booking period becomes a dispute about what was promised, what the payment represented, who received the money or which unit was reserved.

FieldWhat to recordWhy it matters
Project identityOfficial name, project number, phase and developer.Prevents reliance on a similar marketing name.
Unit identityBuilding, floor, unit, type, plan and stated area.Connects the payment to a specific property.
PriceBase price, discount, incentives and currency.Shows whether the booking price matches the later SPA.
Initial amountAmount, due date, description and whether it forms all or part of the price.Distinguishes a sale-price payment from a preliminary reservation or separate charge.
Payment destinationVerified beneficiary, approved collection route and account reference for that amount.Tests whether the requested route fits the amount’s documented character.
Refund wordingEvents, deductions, procedure and payment period.Avoids assuming that “refundable” is unconditional.
Expiry or releaseHow long the unit is reserved and what ends the reservation.Shows when the developer may release the unit.
SPA deadlineWhen the SPA will be issued and must be signed.Creates a traceable transition to the full agreement.
ConditionsFinance, identification, eligibility or other stated conditions.Shows whether failure of a condition changes the amount’s treatment.
FeesRegistration, administration, brokerage or other charges.Prevents the unit price and separate charges being combined.
NoticesEmail, postal address and approved communication method.Matters if a warning, cancellation or clarification is later sent.
Signatures and authorityNames, entities, signatures, dates and representative authority.Identifies who made the recorded commitments.

7. Do not assume the amount is always refundable—or always lost

Read the exact verbs and conditions. “Refundable,” “non-refundable,” “subject to approval,” “subject to finance,” “administration fee” and “credited toward the purchase price” describe different positions. Identify who decides whether a condition failed, what evidence is required, whether deductions apply and when a refund is stated to be processed.

There is no safe universal answer based only on the amount or the document’s title. The effect can depend on the signed wording, authority of the parties, project and transaction stage, legal character of the payment, approved collection route, later SPA, applicable legislation and the reason the transaction did not proceed.

DLD’s published complaint guidance distinguishes regulatory violations from contractual claims. It states that the listed real-estate complaint channel does not consider reservation cancellations, compensation, refunds or contractual disputes. That is a routing limitation, not a conclusion that either party automatically wins. Preserve deadlines and obtain qualified UAE advice where a material sum or alleged default is involved.

8. Set a documented path from booking to the SPA and Oqood record

Ask when the complete SPA will be supplied, how long the buyer has to review it, which plans and schedules form part of it and what happens if the SPA differs materially from the booking form. Compare the project, unit, price, area, payment schedule, handover terms, notices and stated treatment of every earlier amount line by line.

DLD’s current initial-sale service requires the SPA to be signed by the developer and purchaser and states that it must be registered in the provisional register within 90 days from signing. The service issues a provisional-registration e-certificate. The 90-day period should not be moved backward to an earlier advertisement or booking date unless the actual documents and applicable procedure establish that result.

Record the SPA signature date, registration submission reference and certificate date separately. If the developer refuses or delays registration, DLD’s FAQ says an application supported by the relevant documents can be submitted to its Real Estate Registration Assurance section.

9. If the unit, price or terms change, create a discrepancy schedule

Do not overwrite the original booking form. Create a short table identifying the original field, the later field, the date of each record and the clarification requested. Common examples include a changed unit number, different stated area, removed incentive, revised payment schedule or different purchaser spelling.

A difference does not by itself prove improper conduct. It may reflect an authorised renumbering, correction, expired campaign, incomplete early schedule or a proposed change that still requires agreement. Ask the responsible party to identify the source and effect of the change in writing.

Do not sign a replacement merely to keep the reservation alive without preserving the earlier record and understanding whether the replacement releases, varies or supersedes any rights. Material legal consequences require review of the actual documents.

10. Keep the booking file if the project later becomes delayed or distressed

The booking form, advertisement and first receipt can remain relevant years later. They may help identify the original unit, purchaser, price, representations, payment destination and communication addresses before the SPA or registration record was created.

If the project later becomes delayed, under cancellation or cancelled, add current DLD project records, later contracts, Oqood evidence, payment acknowledgements and notices to the same chronology. Do not publish full identity, banking or contract documents in an open owner group.

Development Resolution can help organise a fragmented project and owner record for assessment. It does not decide the legal character or recoverability of a booking amount, compel registration or guarantee project completion.

11. Complete this final check before authorising the payment

Pause where a material field is unresolved. A short reservation deadline does not convert an unknown project, unit, payee, payment character or refund condition into verified evidence. Ask for the missing record and preserve the response.

This checklist does not replace advice on an individual transaction. Its purpose is to ensure that the buyer can later show what was advertised, what was signed, what the payment represented, where the money went and how the transaction was expected to move into the SPA and provisional register.

  • Verify the project number, developer and phase.
  • Scan and preserve the advertisement’s Madmoun QR result.
  • Confirm the broker or representative and their entity.
  • Match the exact unit, plan, stated area and price.
  • Read the payment and refund clauses word for word.
  • Determine whether the amount is sale price, a preliminary reservation, an expression-of-interest fee or another charge.
  • Verify the approved collection route for that specific amount independently.
  • Record every fee separately from the unit price.
  • Confirm when the full SPA will be supplied.
  • Compare the booking form with the SPA before signing.
  • Track the 90-day registration period from the SPA signature date.
  • Obtain the provisional-registration e-certificate, not only a submission reference.
  • Keep all original records and seek qualified advice before an irreversible response to a dispute.

FREQUENTLY ASKED QUESTIONS

Questions about Dubai off-plan booking forms and deposits

Is a Dubai off-plan booking form the same as the SPA?

Not necessarily. A booking form may reserve a unit and record an initial payment, while the SPA normally contains the fuller sale terms. Compare both documents and preserve any difference.

Is every Dubai off-plan booking deposit refundable?

No universal rule can be inferred from the word “deposit.” Read the signed refund conditions, deductions, deadlines and later SPA. Obtain qualified advice where the parties disagree or a material sum is at risk.

Should I pay an off-plan reservation amount into a broker’s account?

Article 12 states that a developer-appointed broker must deposit the relevant unit sale price into the project escrow account and may not deposit that price into the broker’s own account or deduct commission first. This applies where the amount constitutes all or part of the unit sale price. For a preliminary reservation, expression-of-interest fee or separately described charge, verify its legal character, approved collection route and written treatment with DLD or qualified UAE counsel before transferring it.

Does a Madmoun QR code prove the project will complete?

No. It helps verify the advertisement’s permit, authenticity, validity and authorised details. It does not guarantee construction, handover, finance approval, investment returns or the truth of every separate spoken statement.

When should the off-plan sale be registered in Oqood?

DLD’s current initial-sale service states that the signed SPA must be registered in the provisional register within 90 days of signing. Keep the booking date, SPA date, submission date and certificate date separate.

What if the developer delays registering the SPA?

DLD’s FAQ says a buyer may submit an application, with supporting documents, to the Real Estate Registration Assurance section where a developer refuses or delays registration. Preserve the SPA, payment evidence and correspondence.
